• when going about as a Guest or otherwise, enroll or generally request any Homeowner or other User to join third party services or sites that are competitive to Easyspain.nl, without Easyspain.nl’s prior written approval;
• utilise the Services to locate a Homeowner or Guest and after that complete a booking of an Accommodation exchange independent of the Services so as to bypass the commitment to pay any expenses identified with Easyspain.nl’s arrangement of the Services;

ASIDE FROM OUR OBLIGATIONS TO PAY AMOUNTS TO APPLICABLE HOME OWNERS PURSUANT TO THESE TERMS, IN NO EVENT WILL EASYSPAIN.NL’S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND YOUR USE OF THE SERVICES EXCEED THE AMOUNTS YOU HAVE PAID OR OWE FOR BOOKINGS VIA THE SERVICES AS A GUEST IN THE TWELVE (12) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR IF YOU ARE A HOMEOWNER, THE AMOUNTS PAID BY EASYSPAIN.NL TO YOU IN THE TWELVE (12) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), IF NO SUCH PAYMENTS HAVE BEEN MADE, AS APPLICABLE. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN EASYSPAIN.NL AND YOU.

Indemnification

You consent to discharge, defend, indemnify, and hold Easyspain.nl and its associates and backups, and their officials, chiefs, workers and specialists (explicitly including Home Owners), harmless from and against any cases, liabilities, harms, misfortunes, and costs, including, without constraint, sensible lawful and accounting charges, emerging out of or in any capacity associated with (a) your access to or utilisation of the Site, Services, or Content or your infringement of these Terms; (b) your User Content; (c) your (I) interaction with any User, (ii) booking of an Accommodation, (iii) making of a Listing or (iv) the utilisation, condition or rental of an Accommodation by you, including, however not restricted to any wounds, misfortunes, or harms (compensatory, direct, coincidental, important or otherwise) of any sort emerging regarding or because of a rental, booking or utilisation of an Accommodation.

Assignment

You may not assign or transfer these Terms, by activity of law or otherwise, without Easyspain.nl’s earlier written assent. Any endeavor by you to allot or move these Terms, without such assent, will be invalid and of no impact. Easyspain.nl may assign or move these Terms, at its sole discretion, without confinement. Subject to the previous, these Terms will bind and inure to the advantage of the parties, their successors and permitted assigns.

Non-Waiver

The Company’s privileges and remedies will not be reduced, waived or extinguished by the allowing of any indulgence, avoidance or expansion of time by us nor by any disappointment of or delay by us in attesting any such rights or remedies.

Severability
